These Terms of Use and Marketplace Terms ("Terms") govern your access to and use of dumpsterrental.com and any related websites, applications, online ordering systems, quote forms, advertising features, communications, and services operated by Dumpster Rental, Inc. ("Dumpster Rental," "dumpsterrental.com," "we," "us," or "our").
dumpsterrental.com may operate in more than one capacity. Depending on the particular transaction, we may: (1) directly provide or arrange dumpster rental, junk removal, hauling, or related services; (2) use a subcontractor or fulfillment partner to perform services on our behalf; or (3) operate as an advertising, directory, marketplace, or referral platform that connects customers with independent third-party service providers.
The role applicable to a particular order or service request may affect who is responsible for performing the service, establishing pricing, collecting payment, and resolving service-related issues.
By accessing or using dumpsterrental.com, requesting a quote, submitting a service request, placing an order, making a payment, electronically accepting an agreement, creating or maintaining a service-provider listing, or otherwise using our Website or Services, you agree to these Terms and our Privacy Policy.
If you do not agree, you should not use the Website or Services.
1. Our Different Service Roles
A. Services Provided Directly by Dumpster Rental, Inc.
For certain orders, Dumpster Rental, Inc. is the service provider and contracting party.
When we directly accept your order for dumpster rental, junk removal, hauling, or another service, the transaction is between you and Dumpster Rental, Inc. and is subject to these Terms together with any quote, invoice, rental agreement, order confirmation, prohibited-material policy, cancellation policy, or other service-specific terms provided with your order.
B. Services Performed by Our Subcontractors or Fulfillment Partners
Dumpster Rental, Inc. may use subcontracted haulers, independent drivers, disposal companies, recycling facilities, transfer stations, or other third parties to help fulfill an order accepted by Dumpster Rental, Inc.
When such a provider is performing services on behalf of Dumpster Rental, Inc., the use of a subcontractor does not by itself change the customer's contractual relationship with Dumpster Rental, Inc.
We may provide the subcontractor or fulfillment provider with information reasonably necessary to perform the service, including your name, telephone number, service address, dumpster requirements, access instructions, scheduling information, and other relevant service information.
C. Independent Marketplace and Advertising Providers
dumpsterrental.com may also allow independent dumpster rental companies, waste haulers, junk removal companies, demolition contractors, recycling companies, and other service providers ("Marketplace Providers") to advertise, maintain listings, receive customer inquiries, or otherwise promote their independently operated businesses through dumpsterrental.com.
Unless we specifically state otherwise for a particular transaction, Marketplace Providers are independent businesses and are not employees, agents, partners, joint venturers, franchisees, or representatives of Dumpster Rental, Inc.
When a customer independently hires a Marketplace Provider through a listing, referral, advertisement, or lead generated by dumpsterrental.com, the service agreement is between the customer and that Marketplace Provider unless the transaction expressly states otherwise.
2. Identifying Who Is Providing Your Service
Because dumpsterrental.com may both provide services directly and display services offered by independent businesses, customers should review the applicable quote, order confirmation, checkout page, provider information, or service agreement to determine who is providing the service.
Where reasonably practicable, we may identify whether an offering is:

3. Marketplace Listings Are Advertising and Information
Marketplace Provider listings are intended to help customers locate businesses that may offer dumpster rental, hauling, junk removal, demolition, recycling, disposal, or other related services.
A Marketplace Provider may pay Dumpster Rental, Inc. advertising, listing, subscription, lead-generation, referral, promotional, or other fees.
The appearance, prominence, ranking, placement, designation, or presence of a Marketplace Provider on dumpsterrental.com does not necessarily constitute an endorsement, recommendation, certification, or guarantee by Dumpster Rental, Inc.
Sponsored, promoted, preferred, featured, or paid placements may receive different visibility from other listings.
4. Marketplace Provider Independence
Marketplace Providers are solely responsible for operating their businesses and, where applicable, for:
Unless Dumpster Rental, Inc. expressly identifies itself as the provider or contracting party, we are not responsible for a Marketplace Provider's acts, omissions, representations, pricing, availability, workmanship, equipment, employees, subcontractors, disposal practices, licensing, insurance, or services.
5. Marketplace Provider Credentials
Marketplace Providers must provide accurate and current information regarding their businesses.
This may include business names, contact information, service areas, services offered, insurance information, licenses, registrations, certifications, photographs, pricing information, and other business information.
Dumpster Rental, Inc. may request, review, or display certain credentials or information concerning Marketplace Providers. However, unless expressly stated otherwise, the fact that information appears on dumpsterrental.com does not constitute a guarantee that such information remains complete, accurate, current, or applicable to a particular project.
Customers are encouraged to independently verify licenses, insurance, permits, qualifications, and other credentials when those matters are important to their project.
Marketplace Providers are responsible for immediately updating information that becomes inaccurate, expired, suspended, revoked, or otherwise misleading.
6. Licensing and Legal Compliance by Marketplace Providers
Each Marketplace Provider is responsible for determining and maintaining every license, registration, permit, authorization, insurance policy, or certification legally required for the services it advertises or performs.
A provider may not advertise through dumpsterrental.com services that it is legally prohibited from offering.
Where a contractor license or other professional license is required, the Marketplace Provider is responsible for accurately displaying and maintaining the required licensing information.
Dumpster Rental, Inc. may suspend, restrict, or remove listings when we reasonably believe that a provider's information is inaccurate, misleading, expired, unlawful, or creates a risk to customers or the platform.
7. No Guarantee of Marketplace Provider Performance
Dumpster Rental, Inc. does not guarantee that every Marketplace Provider will be available, suitable for a particular project, offer the lowest price, perform services according to a particular standard, or produce a particular result.
Customers are responsible for evaluating Marketplace Providers and deciding whether to enter into an agreement with them.
Any dispute regarding independently contracted services should generally be addressed directly between the customer and the Marketplace Provider that entered into the service agreement.
Nothing in this section limits responsibility that Dumpster Rental, Inc. may have where Dumpster Rental, Inc. itself is identified as the contracting service provider.
8. Marketplace Pricing and Quotes
Marketplace Providers may establish their own rates, fees, included tonnage, rental periods, cancellation policies, prohibited-material rules, additional charges, and other service conditions.
Prices or estimates displayed on dumpsterrental.com for Marketplace Providers may be supplied by the Marketplace Provider or generated using information supplied by that provider.
Unless specifically identified as a binding offer, displayed prices and estimates are informational and may be subject to confirmation by the Marketplace Provider.
Dumpster Rental, Inc. does not guarantee that an independent Marketplace Provider will honor erroneous, outdated, or incorrectly displayed information.
9. Marketplace Contracts and Payments
Unless expressly stated otherwise during a particular transaction, a customer hiring an independent Marketplace Provider enters into a service agreement directly with that provider.
Where payment is made directly to a Marketplace Provider, Dumpster Rental, Inc. is not responsible for the provider's billing, refunds, deposits, payment processing, or collection practices.
dumpsterrental.com may in the future offer payment-processing, booking, or transaction-facilitation services for Marketplace Providers. If such features are offered, additional terms presented during that transaction may apply and will identify the respective responsibilities of Dumpster Rental, Inc. and the Marketplace Provider.
10. Customer Service Requests and Lead Sharing
When you request a quote, request contractor contact, submit project information, or ask dumpsterrental.com to help locate a service provider, you authorize us to use and share information reasonably necessary to respond to your request.
Information may be provided to one or more Marketplace Providers that appear appropriate for your requested service, including information such as your:
Marketplace Providers receiving your information may contact you regarding the service you requested, subject to applicable communications and privacy laws.
Consent to receive marketing communications unrelated to your particular request will be obtained where separately required by applicable law.

11. Services Directly Provided by Dumpster Rental, Inc.
When Dumpster Rental, Inc. is identified as your service provider, you agree to comply with the rental and service requirements applicable to your order.
These requirements may include dumpster size, rental period, included weight, excess weight charges, prohibited materials, delivery and pickup requirements, cancellation policies, access requirements, and additional service charges.
Any transaction-specific quote, rental agreement, invoice, or order confirmation should be reviewed before placing your order.
12. Quotes, Orders and Reservations
Submitting an order, reservation, quote request, payment, or service request does not guarantee equipment or service availability unless and until the applicable service provider confirms the transaction.
Dumpster Rental, Inc. may refuse, modify, reschedule, postpone, or cancel a direct order where reasonably necessary because of equipment availability, payment verification, unsafe conditions, inaccurate information, suspected fraud, disposal restrictions, severe weather, access limitations, government requirements, or other circumstances affecting our ability to safely and lawfully perform the service.
13. Accurate Customer Information
Customers agree to provide accurate, complete, current, and truthful information.

You may not knowingly provide another person's identity, telephone number, email address, billing information, payment method, or other identifying information without lawful authorization.
14. Fraud Prevention and Verification
Dumpster Rental, Inc. may take reasonable measures to verify transactions and protect customers, Marketplace Providers, and our company against fraud.
Verification may include confirming customer identity, billing information, service address, telephone number, email address, payment authorization, property information, transaction history, or other relevant information.
We may use payment processors, financial institutions, identity or address-verification providers, fraud-prevention systems, software providers, public information, or other lawful resources to perform verification.
If fraud, identity theft, unauthorized payment activity, theft, misuse of equipment, or other unlawful activity is reasonably suspected, we may suspend or cancel transactions, retain relevant records, cooperate with payment processors or financial institutions, and disclose information to appropriate authorities as permitted by law.
15. Payments and Chargebacks for Dumpster Rental, Inc. Orders
When Dumpster Rental, Inc. is the service provider, by providing a payment method you represent that you are authorized to use it and authorize us and our payment processors to charge amounts legitimately due under the applicable order or rental agreement.
Customers should promptly notify us of billing concerns so that we have a reasonable opportunity to investigate and address them.
If a payment or chargeback dispute occurs, Dumpster Rental, Inc. may provide relevant evidence to financial institutions, payment processors, credit card networks, insurers, attorneys, courts, law enforcement, or other appropriate parties.
Such evidence may include transaction records, authorizations, signatures, communications, photographs, delivery and pickup records, GPS or service-location information, invoices, receipts, and other documentation relating to the transaction.
16. Dumpster Placement and Property Access
When Dumpster Rental, Inc. provides or arranges a dumpster service, the customer is responsible for providing a safe, legal, and reasonably accessible location for delivery, servicing, exchange, and pickup.
By requesting placement on private property, you represent that you are the property owner or have permission from an authorized person.
Customers are responsible for identifying placement concerns such as:
Dumpster trucks and loaded containers are extremely heavy and may cause cracking, indentation, scratching, staining, or other surface damage.
To the extent permitted by law, Dumpster Rental, Inc. is not responsible for ordinary damage associated with placement on a location selected or approved by the customer except to the extent resulting from our negligence or where liability cannot legally be limited.
17. Permits
Unless expressly agreed otherwise in writing, customers are responsible for determining whether permits or other approvals are required for placement of a dumpster.
This may include street-use permits, right-of-way permits, parking permissions, homeowner-association approvals, or other governmental authorization.
Costs arising from unauthorized placement may be the customer's responsibility to the extent permitted by law.
18. Prohibited and Restricted Materials
Customers may not place hazardous, illegal, toxic, flammable, explosive, radioactive, infectious, or otherwise prohibited material into a dumpster unless expressly authorized and lawful.

Customers are responsible for accurately describing materials before service.
Additional disposal costs, cleanup charges, transportation expenses, fines, penalties, or other costs arising from prohibited or undisclosed materials may be charged to the responsible customer where permitted by law.
19. Weight, Loading and Overfilled Dumpsters
Containers must be loaded safely and within applicable weight and fill restrictions.
Materials may not extend above the container's top edge or otherwise make transportation unsafe or unlawful.
If a dumpster is overweight, overloaded, blocked, inaccessible, improperly loaded, or unsafe for transportation, pickup may be refused until the condition is corrected.
Additional charges may apply for excess weight, prohibited materials, sorting, disposal, return trips, failed pickups, waiting time, or additional handling.
20. Delivery and Pickup Scheduling
Delivery and pickup times are estimates unless expressly guaranteed in writing.
Traffic, weather, road closures, equipment failures, disposal-facility delays, government restrictions, unsafe conditions, customer access issues, and other circumstances may affect schedules.
Customers should not rely upon an estimated arrival or pickup time as a guaranteed appointment unless expressly stated otherwise.
21. Cancellations, Dry Runs and Additional Services
Cancellation, rescheduling, extension, relocation, exchange, dry-run, waiting-time, failed-delivery, failed-pickup, and other charges may apply according to the terms presented with the applicable transaction.
Additional charges may result when a driver cannot safely or legally complete service because of blocked access, locked gates, parked vehicles, improper loading, unsafe conditions, incorrect instructions, or other circumstances outside the service provider's reasonable control.
22. Marketplace Provider Advertising Accounts
Marketplace Providers using dumpsterrental.com to advertise or obtain leads agree that:
23. No Guarantee of Leads or Business Results
Payment by a Marketplace Provider for advertising, listings, subscriptions, placement, leads, or other promotional services does not guarantee any minimum number of calls, inquiries, leads, bookings, customers, revenue, or profits unless a separate written agreement expressly provides otherwise.
Customer demand, competition, location, pricing, seasonality, availability, ranking, advertising performance, economic conditions, and many other factors may affect Marketplace Provider results.
24. Marketplace Provider Content
Marketplace Providers may provide logos, photographs, service descriptions, company information, pricing information, videos, and other content for display on dumpsterrental.com.
By submitting such material, the Marketplace Provider represents that it owns or has permission to use the material and grants Dumpster Rental, Inc. a non-exclusive, royalty-free license to reproduce, display, format, adapt, and distribute the material as reasonably necessary to operate and promote the Marketplace Provider's listing and dumpsterrental.com.
Marketplace Providers remain responsible for the accuracy, legality, and ownership of content they submit.
25. Ratings and Reviews
dumpsterrental.com may allow customers to submit ratings, reviews, photographs, or other feedback regarding Dumpster Rental, Inc. or Marketplace Providers.
Reviews represent the opinions and experiences of the individuals who submit them and do not necessarily represent the views of Dumpster Rental, Inc.
We may moderate or remove content reasonably believed to contain:
We do not promise to remove a review merely because it is negative or because a Marketplace Provider disagrees with the customer's opinion.
Marketplace Providers may not purchase, fabricate, manipulate, or improperly incentivize positive reviews or improperly suppress legitimate negative reviews.
26. Communications
By providing contact information in connection with a specific quote, order, service request, or business relationship, you authorize Dumpster Rental, Inc. and, where applicable, the Marketplace Providers receiving your service request to contact you regarding that request, subject to applicable law.
Marketing and promotional communications will be sent only as permitted by applicable law and applicable consent requirements.
27. Telephone Call Recording
Telephone calls involving Dumpster Rental, Inc. may be monitored or recorded for customer service, quality assurance, training, transaction documentation, fraud prevention, or dispute resolution where permitted by law and after providing any notice or obtaining any consent required by applicable law.
Marketplace Providers are separately responsible for complying with applicable call-recording laws for calls they independently conduct.
28. Electronic Communications and Electronic Signatures
You consent to conducting transactions electronically where electronic processes are offered.
Clicking an acceptance button, checking an agreement box, approving a quote, electronically signing an agreement, submitting an order, or otherwise electronically indicating acceptance may constitute your agreement to the applicable terms to the extent recognized by applicable law.
29. Photographs and Service Documentation
Dumpster Rental, Inc. and providers performing services on our behalf may photograph or otherwise document containers, delivery and pickup locations, materials, property access, loading conditions, container condition, signatures, and other aspects of service when reasonably necessary for business operations, safety, billing, fraud prevention, claims, customer service, or dispute resolution.
The collection and use of such information is further addressed in our Privacy Policy.
30. Website Intellectual Property
Unless otherwise indicated, dumpsterrental.com and its text, graphics, logos, photographs, designs, software, layout, service descriptions, databases, and other proprietary Website content are owned by or licensed to Dumpster Rental, Inc.
No person or business may reproduce, scrape, republish, distribute, commercially exploit, or systematically extract Website content or Marketplace Provider information without authorization, except as permitted by applicable law.

33. Disclaimer of Website Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, dumpsterrental.com, ITS MARKETPLACE FEATURES, AND WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE."
WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
WE DO NOT GUARANTEE THE ACCURACY OF INFORMATION PROVIDED TO US BY INDEPENDENT MARKETPLACE PROVIDERS.
Nothing in these Terms limits warranties or protections that cannot legally be waived.
34. Marketplace Disputes
When a customer independently contracts with a Marketplace Provider, disputes concerning that provider's services, workmanship, pricing, refunds, damages, billing, or performance should generally be resolved directly between the customer and Marketplace Provider.
Dumpster Rental, Inc. may, but is not required to, assist the parties with communications or review complaints.
Providing such assistance does not make Dumpster Rental, Inc. a party to the underlying contract or create responsibility for the Marketplace Provider's services.
This section does not apply where Dumpster Rental, Inc. itself is the contracting service provider.
35. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DUMPSTER RENTAL, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE WEBSITE, MARKETPLACE, OR SERVICES, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.
WITH RESPECT TO AN INDEPENDENT MARKETPLACE PROVIDER, DUMPSTER RENTAL, INC. IS NOT RESPONSIBLE FOR DAMAGES RESULTING SOLELY FROM THE INDEPENDENT PROVIDER'S ACTS, OMISSIONS, WORKMANSHIP, EQUIPMENT, EMPLOYEES, PRICING, REPRESENTATIONS, OR PERFORMANCE, EXCEPT TO THE EXTENT RESPONSIBILITY CANNOT LEGALLY BE DISCLAIMED.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
36. Indemnification by Users
To the extent permitted by law, users agree to indemnify and hold harmless Dumpster Rental, Inc. and its officers, employees, agents, affiliates, and contractors from third-party claims, liabilities, damages, penalties, costs, and reasonable attorneys' fees arising from the user's unlawful conduct, violation of these Terms, unauthorized use of another person's information or payment method, prohibited materials, infringement of third-party rights, or other wrongful conduct.
37. Indemnification by Marketplace Providers
To the extent permitted by law, each Marketplace Provider agrees to indemnify and hold harmless Dumpster Rental, Inc., its officers, employees, affiliates, agents, and representatives from third-party claims, liabilities, damages, governmental penalties, costs, and reasonable attorneys' fees arising from or related to:
38. Suspension and Removal of Marketplace Providers
Dumpster Rental, Inc. may suspend, limit, refuse, or terminate a Marketplace Provider's participation when reasonably necessary to protect customers, our reputation, our Website, or our business.
Reasons may include suspected fraud, repeated customer complaints, inaccurate credentials, expired licensing, unlawful activity, misuse of customer data, deceptive advertising, abusive conduct, nonpayment of advertising fees, or violation of these Terms.
Removal from dumpsterrental.com does not necessarily represent a determination regarding the legal merits of a complaint.
39. Privacy
Collection, use, disclosure, storage, and protection of personal information are governed by the Dumpster Rental, Inc. Privacy Policy, including applicable California privacy disclosures.
40. Governing Law
These Terms are governed by the laws of the State of California without regard to conflict-of-law principles, except where federal law or another applicable law controls.
Any additional dispute-resolution or venue terms contained in a separately executed service-provider, advertising, rental, or other written agreement will apply to matters governed by that agreement.
41. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the provision will be modified or enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.
42. No Waiver
Failure by Dumpster Rental, Inc. to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

Different parts of dumpsterrental.com may be governed by additional agreements.
